I had an RFE from NSC that they wanted to see experience letter from employer from specific format. They specifically said in RFE that they didnt want to see affidavits or paystubs or offer letter or any other document. Remember EB2 category criterion is "5 years of progressive work experience" word progressive is important and offer letter doesnt prove it.
If you havent been in this situation, do not offer unnecessary advise based on your gut feeling.

I don't need to explain to 10 people around my house if I go out and come home late night. These are just a few... I'm 100% sure I would not spend as much as time I spend with my family now excluding the weekends. I can't imagine going early in the morning at 7.00 and coming back home at 9.00 PM watch TV, eat and get to bed. On top of that go to work on weekends deal with relatives, neighbors, colleagues etc etc. Of course How can I forget the CASTE SYSTEM which is becoming as some people call the nation has developed. I cannot imagine my kids growing i the environment where CASTE SYSTEM is so prevalent.

Hi,
I applied my 485 on 18th and reached Neberaska.
I have been calling USCIS for the last 5 weeks.Today they gaveme my receipt number only for I-765 and not for others.These were porcessed on Sep18.i have not had the receipt in hand.
My checks are also not cashed at this time .Is some one in the same sitiuation as I am.

My case was received by NSC on JUN 1st. They issued the recipt numbers on JUN 5th. I am still waiting on my wifes. They could clear on Monday.. Looks like NSC is also trying to speed up things. They are just one day slower than TSC in issuing recepts.

WASHINGTON � Two of the most liberal members of Congress met with two of their most conservative colleagues this week to revive immigration legislation that passed the Senate but was throttled by House Republican leaders who resisted its attempt to grant citizenship to illegal immigrants.

�The plan is to bring the bill up in late winter,� said Rep. Jeff Flake, R-Ariz., a conservative stalwart who attended the meeting in the office of Sen. Edward Kennedy, D-Mass. The other participants were Sen. John McCain, R-Ariz., and Rep. Luis Gutierrez, D-Ill.
The strategy session Wednesday came amid speculation about how the dynamics of the immigration debate might change, if at all, when Democrats take control of the House and Senate next month.
Flake said that Kennedy, who will be chairman of the Senate Judiciary Committee's immigration subcommittee, wants to let the new Congress deal first with issues such as the war in Iraq and proposals to raise the minimum wage.
�Then he'll be ready to go� with a new version of the bill that the Senate approved in April.
Sen. John McCain
Republicans ran the show in both houses of Congress then, and passionate divisions in their ranks over immigration policy became a dominant feature of the debate. Democrats, particularly in the House, were mostly content to sit back and enjoy the stalemate, even as they campaigned against the �do-nothing Republican Congress.�
Now Democrats face the hazards of immigration politics.
Immigration-law changes are conspicuously absent from the legislative agenda laid out by incoming House Speaker Nancy Pelosi. Observers here say it will be difficult for Pelosi, D-San Francisco, to honor her campaign-season pledge to work for a new comprehensive immigration law without splitting a caucus that includes freshly elected Democrats who vowed to secure the border and crack down on illegal immigration.
The November midterm elections seemed to send mixed messages.

In a cliffhanger contest, Arizona Rep. J.D. Hayworth, a conservative Republican and strident foe of illegal immigration, was defeated by Democrat Harry Mitchell.
Immigration advocates such as Ben Johnson of the Immigration Policy Center say Hayworth's defeat showed that immigration �did not turn out to be the firebrand issue that some people thought it could be.�
But immigration restrictionists point out that Mitchell made getting tough on immigration the centerpiece of his campaign. They also say Mitchell cleverly used the issue against Hayworth, saying his Republican opponent was part of a political regime that wasn't competent enough to stop the hundreds of thousands of immigrants that sweep across Arizona's southern border each year.
While Mitchell said he favored legal status for long-established immigrants, he insisted that immigration policy can be fixed only by �members of Congress who are willing to enforce the law, produce real immigration reform and stop playing politics with the issue.�

That enforcement-heavy approach is fine with immigration advocates as long as it is part of a package that provides permanent legal status to those who are beckoned across the border by agriculture, restaurant, construction, landscaping and janitorial jobs. The number of illegal immigrants in the United States is estimated to be at least 11 million.
Immigrant-rights advocates, along with their allies at the National Chamber of Commerce and other business organizations, also support a proposal to provide hundreds of thousands of low-wage workers every year for employers who demonstrate that they are unable to find Americans to fill the slots.
While McCain and Kennedy describe this as a �temporary-worker program,� the legislation they sponsored would put the workers on a path to citizenship.
At a time of anxiety about the loss of good-paying manufacturing jobs, the McCain-Kennedy bill's efforts to import low-wage labor has drawn the anger of critics across the political spectrum. That is why Mark Krikorian of the Center for Immigration Studies, which advocates immigration restrictions, predicts Pelosi will be reluctant to get behind a proposal that could endanger the new Democratic majority.
�Nancy Pelosi knows the Democrats are on probation for the next two years,� Krikorian said.
He predicted that Pelosi would back less ambitious immigration change, such as a plan to provide legal status to undocumented students, rather than take on the explosive issue of mass legalization, which critics condemn as an amnesty that would spawn more illegal immigration.
But Frank Sharry, executive director of the National Immigration Forum, which advocates for immigrant rights, argues that next year will be pivotal because of the presidential race that follows.

�I think that once we hit primary (election) season, controversial issues get a lot harder to do,� Sharry said. �Everybody I talk to says 2007 is the window of opportunity.�
Pelosi was noncommittal this week on whether the House would take up immigration legislation. She sought to deflect some of the responsibility to the White House, suggesting that she expects President Bush to offer more specifics than his call to �match willing worker with willing employer.�
�That's up to the president,� Pelosi said. �We want to work closely with him because it has to be comprehensive and bipartisan.�

I dont have access to the certified labor copy , I am just wondering if we need it for AC21 purposes. I am not sure how to get it from my desi employer/ desi lawyer. I have a job offer with a fortune 200 company which is willing to do H1b transfer/extension so I am opting for H1b instead of EAD. I am pretty sure about the job description will satisfy the same/similar test.
Is the job title and job description mentioned on the labor cert? Mine is a pre perm case. Is it good to have copy of labor cert for AC21?

I have been following this thread and you know what, This is THE thread that is going to change the future and lot of things to come.
Personal Information :
I understand some of your concerns of giving personal information, but just think about it, all you are giving is your Email Address and Phone number. You are not giving away Credit card, SSN and Bank Account numbers. Just think about it, Dont you guys already get junk emails and marketing calls. Are you guys not getting mails about Credit Card offers, Macys and Others. So Dont think too much guys. You always have the option of changing the phone number if things get worse. But I dont think that is gonna happen since most of our information are already out there. We will try to work out something with the Admins here to see if we can get a secured page. If not, let one of us take a responsibility of collecting personal information and host a webpage, I know, atleast , one of us can do it.

Guys, Lawyer fees is not an issue, if we get more people in to this. 100 $ ain't too much when you think , you are spending 1000 $ on EAD and AP year after year. Let us shake the USCIS by taking some courageous step. Again, we are not here crossing borders, they invited us here. Every one of us deserve justice and respect. They cant treat us like slaves. They gotto keep up to their promises or else we will demand it.

Our focus should be to get maximum support. Let us send the Letter that we agreed upon, first to, the people from whom,we think, we would get maximum support. Let us keep them aware of what we are trying to achieve. Yes, Iam talking about the list of forture 500 Companies and IT giants, who were trying to push for an increase in H1B quota. Companies that are demading for a better Immigarion system and faster green cards. I know, we already have a thread that has a link to the letter that is signed by all big companies in favor of increasing High-Skilled immigrants. Let us make them hear. Let us, all 70 K folks here, send individual letters to every body who,we think, will support us and then to send it to those, who already knows everything about their inefficiencies,but still falling deaf, on our earlier outcry. Let us prove that, we dont just sit out there crying. Let us show them who we really are. Stand for our Self-Respect guys.

Did anyone get their physical Cards without getting CPO message ?
I have recd the I-797C Approval notice on the 11th but I have not recd the physical cards as yet. BTW I did not get any welcome e-mail or CPO mail - I directly got 485 Approval e-mail and that is all.

I am the same boat, got the approval email and a week later received the approval notice in the mail. Did not get welcome or CPO email. My approval notice says I MAY have to do biometrics again to get my PR card
and they will notify me about appearing for biometrics if required.

I have recd the I-797C Approval notice on the 11th but I have not recd the physical cards as yet. BTW I did not get any welcome e-mail or CPO mail - I directly got 485 Approval e-mail and that is all.

I am the same boat, got the approval email and a week later received the approval notice in the mail. Did not get welcome or CPO email. My approval notice says I MAY have to do biometrics again to get my PR card
and they will notify me about appearing for biometrics if required.
Dose your approval notice have a similar message?

Why don;t you sign unless it say until and after 1 year approval:, you can leave employment after 6 months of filing I-485 and see what happens at that time, you have nothing to loose

If GCs were sold in stores I would buy you and your family a bunch of them.
You are in the EB3 category, do you ever wonder why somebody who is more educated than you or me, makes more money? Can we say, hey you I was born in 1890 I should make more money, it does not fly, EB3 is not a reflection on your skills but more the job you hold.
The question you should ask is why have EB1, 2, 3, etc?
Why do you not include the family based categories, isn't family first, why not the EB spill over to to FB first then whatever trickles down comes to EB, is not this fair? I am sure there are a lot in the FB queue who have waited for longer than you. Now dont tell you you are better than FB because you are highly skilled, pay taxes, etc.
You signed up for this knowing what was in store.

I just wonder, is IV some kind of therapy? something like weightwatchers,
maybe we should call ourselves GCWatchers, for frustrated GC folks from India.

Therefore dont think you are as an EB2 more (or less) entitled to anything, and correct the "faltu" ideas in your brain

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

I called my attorney today to inquire about this and he told me that one-third to one-fourth of the applications that he has filed in July are yet to receive the FP notices and he asked me not to worry about it.
Hope he is true and that we will be getting the FP notices soon.
I will keep you all updated

I dont think he 'threatened' EB2. He challenged. But if you were frightened, it is not his problem. who should go where?!
Sorry to read blaming debates between eb3 and eb2. Insted of blaming, it is better to take some action. Based on current practice by DOS, EB3-I will be like this for ever, unless more number opens up by any legislative changes. As per law, each EB catagories are allowed to have 40K visas. As demand for EB2 is more, (paricularly by In,Ch) one can not expect any flow from EB2 to EB3 . This is law one can not change it.
Now I am coming to important point to take some action by EB3-I. The law says, 7% country quota will be applied in each prefrence catagory if worldwide demand for visas is more than supply in that catagory. But the law does not set any time frame. Therefore, the real threat for EB3-I is EB3-ROW. As per current practice, untill EB3-ROW become "current" EB3-I will get only 3000 visas per year. What happen if EB3-ROW never become "current" for next 50 years? EB3-I will be stuck in 2001 or 2002 for ever. To add my point, let us imagine a hypothetical case. Lets say in 2010 about 1 million ROW guys neend EB3 visa number. All has PD 2010. EB3-In will be stuck in 2001 till one million EB-ROW with PD 2010 recives GC. In nut shell, a EB3-ROW with latest PD will be given more preference than EB3-In with PD 2001. As current practice does not set any time limit, new flow of applications keeps retrogressed countries stuck for ever. This point has to be conveyed to DOS and USCIS to change the practice. Applications receviced in one fiscal year has to be cleared (grant GC) to process the application from next year. This way new applications from ROW will not stuck the retrogreesd countries for ever.
